1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and The Kids Era ("Company", "we", "us", "our"), a children's book and toy rental subscription service registered in Maharashtra, India.

By creating an account, subscribing to a plan, or using any part of our Platform, you confirm that you are at least 18 years of age, or that you are a parent/legal guardian acting on behalf of a minor, and that you accept these Terms in full.

2. Description of Services

The Kids Era provides the following services:

• Monthly subscription-based rental of curated books and toys for children aged 0–12 years
• Doorstep delivery and pickup across serviceable pin codes in India
• Expert-curated reading recommendations based on a child's age and interests
• Access to live online workshops, events, and storytelling sessions
• A mobile application for managing subscriptions, orders, and reading progress

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to subscribers.

3. Subscription Plans

We offer multiple subscription tiers (Starter, Classic, Premium) with varying quantities of books and toys per month. By subscribing:

• You agree to pay the applicable monthly fee in advance
• Your subscription auto-renews each month unless cancelled before the renewal date
• Plan upgrades are effective immediately; downgrades take effect from the next billing cycle
• Sibling discounts apply only to the Premium plan and must be requested at the time of subscription

4. Rental Terms and Conditions

4.1 Borrowing

• Books and toys are lent to you for one rental cycle (typically 30 days) unless otherwise specified
• Items remain the property of The Kids Era at all times
• You are responsible for items from the time of delivery until their return

4.2 Care and Return

• Items must be returned in the same condition as received — reasonable wear is acceptable
• Writing in, tearing, or damaging books/toys will result in a damage fee
• Lost items will be charged at the item's full retail price
• Items must be returned using the prepaid return labels or via our scheduled pickup service

4.3 Damage Fees

• Minor damage (small stains, bent pages): ₹50–₹150 per item
• Significant damage (torn pages, broken toy parts): ₹150–₹500 per item
• Lost/unreturned items: Full retail price of the item

5. Payment Terms

• All payments are processed securely through Razorpay
• Subscription fees are charged at the beginning of each billing cycle
• Prices are inclusive of applicable taxes unless stated otherwise
• Failed payments may result in suspension of your subscription until resolved
• We accept UPI, credit/debit cards, net banking, and wallets

6. Intellectual Property Rights

All content on the Platform — including but not limited to logos, text, graphics, images, app design, and curated reading lists — is the exclusive property of The Kids Era and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

7. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Provide false or misleading information
• Attempt to gain unauthorised access to any part of our systems
• Resell, sublease, or transfer rented items to third parties
• Use rented items for commercial purposes
• Harass or abuse our customer support staff

8. Events and Workshops

• Event registrations are subject to availability
• Paid events are non-refundable unless cancelled by The Kids Era
• Free member events require registration; no-shows may result in future access restrictions
• The Kids Era reserves the right to reschedule or cancel events with reasonable notice

9. Limitation of Liability

To the fullest extent permitted by law, The Kids Era shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our services. Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the subscription in the three months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account for violation of these Terms, non-payment, misuse of rented items, or any activity that is harmful to The Kids Era or its users. Upon termination, all rented items must be returned immediately. You may cancel your subscription at any time through the app or by contacting us.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996.

12. Changes to Terms

We may revise these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the Platform after such changes constitutes acceptance of the updated Terms.
